TERMS AND CONDITIONS

Personal Training & Fitness Instructor Terms and Conditions

Welcome! These Terms and Conditions (T&Cs) outline the agreement between you, the client (referred to as "Participant"), and Brinny Joy Roe / Brinny Does Limited, the personal trainer/fitness instructor (referred to as "Coach"). By engaging in services with the Coach, the Participant agrees to these T&Cs.

1. Scope of Services

1.1. The Coach will provide personal training and/or fitness instruction services as agreed upon in a separate service agreement or package details. This may include individual sessions, group classes, and general fitness guidance. 1.2. Services do not include medical diagnosis, treatment, or nutritional meal planning unless explicitly stated and provided by a qualified professional holding relevant certifications. 1.3. The Coach commits to delivering services with professional care, skill, and diligence. The Coach holds valid Public Liability Insurance for all services provided.


2. Fees and Payment Terms

2.1. All fees for services, packages, and payment schedules will be clearly communicated and agreed upon prior to the commencement of services. 2.2. Payments are due by the agreed date. Failure to pay may result in suspension of services until payment is received. 2.3. Accepted payment methods will be specified by the Coach.


3. Cancellation and Refund Policy

3.1. Participants must provide a minimum of 24 hours notice for cancellation or rescheduling of sessions. 3.2. Sessions cancelled with less than the required notice will be charged in full. 3.3. Refunds for pre-paid packages or sessions are generally not provided for unused sessions, except in exceptional circumstances at the sole discretion of the Coach.


4. Confidentiality and Data Protection

4.1. The Coach commits to protecting all personal and health information provided by the Participant in accordance with UK data protection laws (GDPR). 4.2. Participant data will be used solely for the purpose of providing safe and effective training, communication, and administrative tasks. 4.3. Participants have the right to access, correct, or request deletion of their data. 4.4. Any discussions regarding personal progress or sensitive information will be kept confidential between the Coach and Participant. Participants are also expected to respect the privacy of others; personal questions about someone’s body, medical history, or transition (if applicable) should not be asked unless explicitly invited to do so. 


5. Liability Waiver and Assumption of Risk

5.1. Participants acknowledge that physical exercise involves inherent risks, including but not limited to, muscle strains, sprains, and more serious injuries. 5.2. Participants voluntarily agree to participate in the fitness activities and assume all risks associated with participation. 5.3. Participants agree to waive and release the Coach from any and all claims, demands, or causes of action for injury, death, or property damage arising out of participation in the Coach's services, provided that the Coach has not acted negligently or with wilful misconduct.


6. Health and Safety Protocols

6.1. Physical Health:

  • Participants must complete a Physical Activity Readiness Questionnaire (PAR-Q) or similar health screening prior to starting any programme.
  • Participants must disclose all relevant medical conditions, injuries, medications, and health changes to the Coach promptly.
  • Participants are encouraged to listen to their bodies and immediately inform the Coach of any pain, discomfort, dizziness, or unusual symptoms during exercise.
  • The Coach reserves the right to modify or stop any exercise if they believe it poses a risk to the Participant's health or safety.


6.2. Psychological Health:

  • The Coach aims to create a supportive and non-judgemental environment. Participants are encouraged to communicate any concerns or discomfort regarding the training process or environment.
  • The Coach will maintain professional boundaries and expects Participants to do the same.
  • Participants are encouraged to provide feedback constructively and respectfully.


7. Our Community Pact: Code of Conduct

This Code of Conduct applies to all Participants and the Coach, fostering a safe, respectful, and inclusive environment. 


7.1. Respect and Inclusivity: As a neurodivergent and non-binary individual, Brinny Joy Roe is deeply committed to fostering a safe, respectful, and inclusive environment for all. My coaching philosophy is rooted in understanding and celebrating diverse experiences, ensuring everyone feels truly seen and valued.


  • Treat all individuals with courtesy, kindness, and respect, regardless of their background, experience, fitness level, age, race, ethnicity, religion, gender identity, sexual orientation, disability, or neurotype. This includes consistently using a person's chosen name and pronouns. If you are unsure of someone's pronouns, please politely ask. Avoid assuming anyone’s gender based on appearance, voice, or name. When addressing groups, use gender-neutral language (e.g., 'Hi everyone,' 'Hello folks'). If you accidentally misgender someone, apologise briefly and sincerely, then correct yourself and move on without drawing excessive attention to the mistake. Your intention is not always the impact.
  • Affirming Language: Always use a person's chosen name and pronouns. If unsure, use gender-neutral language or politely ask. Apologise briefly if a mistake is made and correct it.
  • Neurodivergent Affirmation: I value diverse ways of thinking and experiencing the world. Please communicate your needs (e.g., sensory sensitivities, need for clear/direct instructions, processing time), and we will strive to adapt where possible. Presume competence and respect individual communication styles.
  • Foster a welcoming environment where everyone feels comfortable, safe, and empowered to participate.


7.2. Safety and Responsibility:

  • Follow all instructions from the Coach regarding exercises, equipment use, and safety protocols.
  • Be mindful of your surroundings and other participants to prevent accidents or injuries.
  • Report any equipment malfunctions or safety concerns to the Coach immediately.


7.3. Professionalism and Boundaries:

  • Maintain a respectful tone in all communications. Avoid disruptive or aggressive behaviour.
  • Respect personal space and boundaries of others. Unsolicited physical contact is not permitted. Avoid staring or reacting to guests’ appearance, clothing choices, or bodies. In shared spaces, privacy norms will be reinforced, and all guests are reminded that everyone deserves comfort and respect.
  • Avoid soliciting or conducting unauthorised personal training sessions on the premises if training in a shared facility.


7.4. Cleanliness and Hygiene:

  • Wipe down equipment after use (if applicable).
  • Maintain personal hygiene and be considerate of others (e.g., using deodorant, bringing a towel).
  • Dispose of rubbish properly. 


7.5. Personal Belongings and Technology:

  • Participants are responsible for their personal belongings. The Coach is not liable for lost or stolen items.
  • Silence or turn off electronic devices during sessions/classes. Avoid disruptive phone conversations.
  • Respect the privacy of others; avoid taking photos or videos without explicit consent.


8. Feedback and Enforcement

8.1. Feedback: Participants are encouraged to provide constructive feedback to the Coach to help improve services and the overall experience. 

8.2. Consequences: Violations of this Code of Conduct or these Terms and Conditions may result in warnings, suspension of services, or termination of the agreement, at the Coach's discretion, without refund for unused sessions. 

8.3. Reporting: Any conduct violations or concerns should be reported directly to the Coach for appropriate action. In case of conflict or discomfort, the Coach will lead with curiosity and care to ensure everyone feels comfortable. Participants are encouraged to communicate any issues directly and respectfully. 9. Governing Law

9.1. These Terms and Conditions shall be governed and construed in accordance with the laws of England and Wales.

By proceeding with services, the Participant acknowledges that they have read, understood, and agree to these Terms and Conditions.
